Status of this document
These terms are published so they can be read before a conversation rather than after a signature. Jurisdiction-specific legal review is outstanding and is required before the first pilot engagement; until that review is done, the terms that apply to your engagement are the ones in your order form.
1. Who these terms are between
BarrierLedger is a product of Front End Engineering Consultancy Limited (“FEEC”, “we”, “us”). FEEC’s company details, including its registered office and company number, are published on feec.asia. These terms are between FEEC and the person or organisation using the website or the platform (“you”).
2. The website
The marketing site at barrierledger.com is provided for information. You may read it, link to it and print it. You may not scrape it at volume, republish it as your own, or use it to misrepresent what BarrierLedger does.
Screenshots and walkthrough screens on this site show the fictional Demo Petroleum tenant. They are illustrative. They are not a customer’s data, and no real operator is named or depicted as a user.
3. The platform
Access to the BarrierLedger platform is governed by the subscription or licence terms in your order form, together with the documents listed in section 9. Where these website terms and an order form disagree, the order form prevails.
You are responsible for:
- the accuracy of the register, readings, limits and policy documents you supply;
- keeping your account credentials and one-time codes confidential;
- the users you invite and the roles you give them; and
- regulatory submissions and official well records. BarrierLedger produces in-house integrity reports. It does not file anything with a regulator, does not certify compliance with any regime, and does not approve a well.
4. No engineering advice, no warranty of a status
An integrity status produced by the platform is the output of the method profile you and FEEC agreed, applied to the data you supplied. It is an engineering record, not a guarantee that a well is safe, and not a substitute for the judgement of a competent person.
The website is provided as it is. We do not warrant that it will be uninterrupted or error-free, or that it is free of anything harmful.
5. Intellectual property
FEEC and its licensors own the platform, the website, the method profile structure, the BarrierLedger name and mark, and the documentation we provide. You own your registers, schematics, well records and other data. Nothing in these terms transfers ownership of your data to us.
You grant us the licence we need to process your data in order to provide the service, as set out in the Data Processing Agreement.
6. Acceptable use
You must not use the platform to:
- access another tenant’s data, or attempt to;
- reverse engineer or copy the platform except as permitted by law;
- introduce malicious code, or use the platform to store or transmit unlawful material; or
- resell access to a third party without a written partner arrangement.
7. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that, our total liability arising out of or in connection with the platform or the website is limited to the fees paid for the twelve months preceding the claim, and we are not liable for indirect or consequential loss, loss of profit, or loss of production.
8. Changes
We may update the website and these terms. A material change to the subscription terms takes effect from your next renewal, and we will tell you before it does.
